These terms govern your use of Gary, an invoice follow-up service provided by Orjelumi Ltd at gogary.co.nz. By signing in and using Gary, you agree to them.
The service
Gary connects to your Xero account, finds overdue invoices, and places follow-up calls and messages to your customers on your behalf. Where you enable it, Gary can also take a card payment from a customer during a call, and arrange a short instalment plan for a customer who cannot pay in full. It is a tool to help you get paid; it is not a debt-collection agency, a law firm, or financial advice.
Your responsibilities
You must have the right to contact the customers you ask Gary to call, and the details you provide must be accurate. You are responsible for how you use Gary and for keeping your account secure. You must use it only for lawful invoice follow-up.
Calling rules and compliance
Gary follows the calling rules built into the service: it discloses recording at the start of each call, keeps within permitted calling hours, honours do-not-call requests, and waits for your approval before the first call to a customer. You must not use Gary to harass anyone or to break the law.
Credits and payment
Gary runs on prepaid credits. Calls use credits at the rates shown in the app. Credits are bought in advance and are non-refundable once used. We may change prices on notice.
Taking payments from your customers
Card payments. Where you turn this on, Gary can take a payment from your customer by card during a call. The card is keyed on the phone and handled by our payment providers; we never see or hold the card number. The money reaches your bank account in full — your customer pays the card processing fee on top, so it costs you nothing. You authorise Gary to take these payments as your agent and to issue a receipt. Payments run through Stripe, and disputes and chargebacks follow Stripe's process.
Payment plans. Where you turn this on, and a customer cannot pay in full, Gary can split the invoice into a few equal instalments over a short period. You authorise Gary, as your agent, to agree the plan, to store the customer's card securely with our payment provider, and to charge each instalment on its due date. Gary lends nothing and advances nothing: you are paid each instalment only as your customer pays it. There is no interest and no plan fee — only the ordinary card processing fee, which your customer pays.
Third-party services
Gary relies on third parties, including Xero, Microsoft, Twilio, and ElevenLabs. We are not responsible for outages or changes in those services that affect how Gary works.
Availability and liability
We aim to keep Gary running but do not guarantee it will be uninterrupted or error-free. To the extent the law allows, Orjelumi Ltd is not liable for indirect or consequential loss, and our total liability is limited to the credits you paid in the three months before the claim. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 where it applies.
Ending your use
You can stop using Gary at any time. We may suspend or end access if these terms are broken. Unused credits may be refunded at our discretion.
Governing law
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.
